Much has been said about the Massachusetts Board of Registration in Pharmacy ruling against Wal-Mart and requiring it to immediately being providing the emergency contraception drug (aka “morning-after” or “Plan B”). Many folks are arguing that such actions are anti-American, new, and unconstitutional. In fact, the ruling is none of these.
Wal-Mart itself is not being required to provide this drug, its pharmacy is. By operating a pharmacy, you agree to abide by the regulations set forth by the state. Don’t want to follow the rules? Don’t operate a pharmacy. I can’t walk into Walgreens and buy a 5 gallon bucket of Oxycontin whenever I feel like - is the government unfairly telling Walgreens what it can’t sell me?

1I agree that all pharmacies should carry the morning after pill as long as it’s a legal alternative for women. The stores are not here to make a moral statement, just sell us things.
